Up to 15 years guarantee against corrosion

The company DELWYN ENTERPRISES (referred to hereafter as “the Company”) offers the purchaser, within the conditions below, a contractual up to 15 years guarantee on the garden sheds and garages that it markets under the brand YARDMASTER INTERNATIONAL (referred to hereafter as the “Product(s)”).
Independently from the contractual guarantee thus agreed, the Company remains bound, vis-à-vis the purchaser, by the legal guarantee. The application of the guarantees is subject to the respect of the specifications of the assembly, maintenance and usage instructions, and more generally any information sent in writing by the manufacturer relating to the Product.

1. Duration of the guarantee

The contractual guarantee is stipulated for the benefit of the purchaser for a period of up to 15 years from the Product’s purchase date.

2. Territorial extent

This contractual guarantee is applicable in the territory where the Product is sold to the purchaser.

3. Content of the guarantee

• Extent of the guarantee

The contractual guarantee covers all of the steel components of the Product with the exception of fixings such as screws, nuts, assembly bolts and, more generally, any type of assembly part. The contractual guarantee covers rust perforations that occur within the context of the normal assembly, maintenance and use of the Product.

• The guarantee’s exclusions:

The guarantee cannot be applied when the Product’s rust perforations are directly or indirectly due to:

• The non-respect of the stipulations of the Product’s assembly, maintenance and usage instructions.
• The poor handling of all or some elements of the Product, as described in the YARDMASTER assembly instructions, during the transportation
  or assembly.
• The non respect of the transportation, installation or usage instructions for all or some elements of the Product, as described in the YARDMASTER assembly instructions.
• The modification or alteration to the Product or all or some of its elements (whether this is carried out by the purchaser or a third party).
• Any aerial or land-based pollution, which could reasonably be considered as abnormal, that is to say more significant than the generally permissible levels of pollution.
• Any chemical reaction resulting notably from the storage or the use of fertiliser, weed killers, plastics or any other chemical products.
• Any act of vandalism or, more generally, any event assuming the characteristics of ‘force majeure’.
• The contractual guarantee does not extend to indirect damages suffered by the purchaser as a result of the perforation of his/her Product.
• The contractual guarantee cannot be transferred to a subsequent purchaser of the Product.

4. Validity conditions of the contractual guarantee

The purchaser must detach and return the duly completed and signed guarantee certificate attached, accompanied by proof of purchase to
DELWYN ENTERPRISES (YARDMASTER INTERNATIONAL), Cahore Road, Draperstown BT45 7AP, U.K, within 21days of the date of purchase. Failure to respect this time period means that the client will not be able to benefit from the contractual guarantee.

5. Guarantee implementation conditions

For this contractual guarantee to be implemented, the purchaser should inform the Company of any imperfection affecting all or part of the Product when they discover it.

Upon receipt of the guarantee request, the Company will respond to the purchaser within a reasonable time frame to let him/her know if the Product’s repair or replacement is or isn’t covered by this contractual guarantee.

If the Product is covered by the contractual guarantee as stipulated by the provisions above, the Company is committed to replacing the parts of the Product that have been perforated by rust within a reasonable time frame.

In the event of a breach by the Company of its obligations above, the purchaser can demand a discount on the purchase price. The transportation, as well as the re-assembly of new parts sent by the Company remains the responsibility of the purchaser.

6. Applicable Law

This contractual guarantee, its execution and its interpretation are subject to the laws of the place where the terms of the Product’s sales contract are fulfilled.
